Terms of use

These terms apply to your use of the websites castingagenda.nl and castingagenda.com and the web app that comes with it. By creating an account or using the app, you agree to them.

1. Who we are

2. What Casting Agenda is, and what it isn’t

Casting Agenda is a personal planning and admin tool. You use it to keep track of your casting options, shoot days, locations, agencies and fees.

Casting Agenda is explicitly not:

  • a casting agency or intermediary;
  • a party that signs you up for productions or arranges roles for you;
  • your employer or client;
  • accounting software, or a source of tax, legal or financial advice.

We have no connection whatsoever with the casting agencies, productions or broadcasters you add to your agenda. Any arrangements you make with them are entirely separate from us.

3. Your account

  • You create an account with a valid email address that you manage yourself, and a password of at least 8 characters.
  • When you sign up, you agree to these terms by ticking a required checkbox. We record when you agreed and to which version of these terms. If the terms change, we’ll ask you to agree again in the app.
  • You are at least 16 years old, or you use the service with permission from your parent or guardian.
  • You create one account for yourself and don’t share your login details.
  • You are responsible for everything that happens through your account. If you suspect misuse, change your password right away and let us know.
  • You can only change your email address or password with your current password. A new email address only becomes active once you’ve confirmed it.
  • Your iCal link opens your agenda without logging in: anyone who has that link can see what’s in it, so don’t share it. Your availability link is meant for sharing and only shows dates, no productions or locations. You can replace either link with a new one on your account page; the old one then stops working.

4. What you enter

The content of your agenda stays yours. We only use it to provide the service: storing it, showing it, exporting it, syncing it, and sending you reminders and overviews about it. We don’t sell your data and we don’t use it for advertising.

You are responsible for what you enter. You make sure that you:

  • don’t store information covered by a production’s non-disclosure agreement;
  • don’t enter other people’s details without a good reason;
  • don’t store unlawful, offensive or infringing content;
  • only upload files you have the right to use.

5. What’s not allowed

  • Using the service for anything other than your own personal admin.
  • Collecting data automatically or querying the app on a large scale (scraping).
  • Trying to access other people’s accounts or data.
  • Bypassing, testing or stress-testing the security without our written permission.
  • Overloading the service or disrupting how it works.
  • Copying, reselling or offering the app or parts of it as your own service.

6. Reminders, notifications and emails

Casting Agenda can remind you of your shoot days by email or push notification. For each option, you choose when you get a reminder, or turn it off. We also send tips, such as a nudge about options that have been open for a while, and once a month an overview with a backup of your options. You can turn these off on your account page.

Reminders are a helpful tool, not a guarantee. Delivery depends on your device, browser, network, email provider and notification settings, and may be delayed or not arrive at all.

You remain responsible for your own appointments. A missed notification is not a valid reason to miss a shoot day, and we are not liable for it.

7. Fees and admin

You can keep track of fees, payment terms and payment statuses. These are your own notes: we don’t check them, we don’t collect any money, and we have no insight into what an agency or production actually pays out. The overviews in the app are not bookkeeping and not tax advice. If in doubt, ask an accountant or tax adviser.

8. Availability and changes

We do our best to keep the service running well, but we can’t guarantee it will always be available without interruption. Maintenance, outages or problems at third parties can make the app temporarily unreachable. We may add, change or remove features. If we make major changes, we’ll let you know in advance.

The service is currently free. If we introduce paid features in the future, we’ll announce this in advance, and nothing about your existing account will change without your consent.

9. Taking your data with you or deleting it

You can export your options as a CSV or Excel file at any time. If you delete your account, you can undo this within 24 hours by logging in again. Just before deletion, you automatically receive an email with an export of all your options, even if you hadn’t exported them yourself. Your account and all related data are permanently deleted no later than 48 hours after your request. This cannot be undone.

10. Termination by us

We may block or delete an account if you break these terms or in case of misuse. We also automatically delete:

  • accounts whose email address hasn’t been confirmed after 14 days;
  • accounts without options that haven’t been used for 30 days, if you also don’t log in within 7 days of our warning.

We never delete accounts with options because of inactivity. Except in cases of serious misuse, we always warn you by email first, so you can respond or export your data.

11. Liability

The service is provided as is. To the extent permitted by law, we are not liable for indirect damage, missed jobs, missed income, missed shoot days or loss of data. Our liability is in all cases limited to the amount you paid us in the preceding twelve months; for free use, that amount is zero.

This limitation does not apply in case of intent or deliberate recklessness on our part, nor where the law does not allow liability to be limited.

Make regular exports yourself as a backup of any data that matters to you.

12. Intellectual property

The website, the app, the name Casting Agenda, the logo and the design belong to us. You get a personal, non-transferable right to use them for as long as your account exists. The content you enter yourself stays yours.

13. Changes to these terms

We may update these terms. The date at the top shows when that last happened. If we make important changes, we’ll ask you to agree again in the app.

14. Applicable law

These terms are governed by Dutch law. Disputes are submitted to the court that has jurisdiction under the law. If you are a consumer, you always keep the rights the law gives you.
